Comparison: State vs. Federal

Rules. Oregon has adopted by reference the federal hazardous waste disposal rules for facilities and added several more stringent rules in connection with surface impoundments, land treatment facilities, permits, and fees for hazardous waste disposal facilities. The Department of Environmental Quality (DEQ) may also, at its discretion, prohibit the land disposal of any hazardous waste.

In addition, several more state provisions make Oregon's standards for land treatment facilities and hazardous waste incinerators more stringent than the federal rules. See the state sections INCINERATION OF WASTES, LAND TREATMENT, and TSDF PERMITS for more information.

Administration and enforcement. DEQ's Hazardous Waste Program administers and enforces the hazardous waste disposal rules in Oregon.
