Comparison: State vs. Federal
• Rules. Tennessee follows the federal requirements for disposal facilities but requires such facilities to pay permit application fees and an annual facility maintenance fee.
Unlike the federal rules, the state prohibits comanagement of hazardous waste in hazardous waste management units unless certain conditions are met. Also, in contrast to the federal requirements, Tennessee's permit rules distinguish between commercial and noncommercial disposal facilities.
• Administration and enforcement. The Tennessee Department of Environment and Conservation's Division of Solid and Hazardous Waste Management administers and enforces the hazardous waste disposal requirements in Tennessee.
