Comparison: State vs. Federal
• Rules. Arizona rules for exporting and importing hazardous waste to and from a foreign country are the same as the federal regulations with an additional requirement concerning annual reports. The federal hazardous waste export and import regulations were revised, effective December 31, 2016, and are in effect in all states as of that date. The Arizona Department of Environmental Quality (ADEQ) will amend its regulations to mirror the revised federal provisions, which are more stringent than the ones they replaced. In the meantime, the federal regulations must be followed in the state. See the national section HAZARDOUS WASTE EXPORTS AND IMPORTS for detailed information.
Internationally, a number of countries have laws with restrictions on the import of hazardous substances and electronic equipment that contain certain hazardous chemicals. See the national sections ELECTRONICS and CHEMICALS for more information concerning these international directives.
• Administration and enforcement. The U.S. Environmental Protection Agency (EPA) administers and enforces the foreign export and import rules in Arizona. ADEQ's Waste Programs Division administers and enforces the state annual report requirement.
