Comparison: State vs. Federal
• Rules. The hazardous waste management rules in Pennsylvania include both the federal Resource Conservation and Recovery Act (RCRA) rules and several more stringent state requirements. The state's rules apply to hazardous waste generators; transporters; owners and operators of hazardous waste treatment, storage, and disposal facilities (TSDFs); handlers of universal waste; and handlers of used oil.
• Administration and enforcement. Pennsylvania has received RCRA authorization from EPA. RCRA authorization allows the Pennsylvania Department of Environmental Protection's (DEP) Bureau of Waste Management to administer and enforce the state's hazardous waste management rules.
