Comparison: State vs. Federal

Rules. Arkansas's regulations for hazardous waste generators follow the federal rules, with additional state requirements mandating the use of permitted hazardous waste transporters; treatment, storage, and disposal facilities (TSDFs); and additional reporting requirements. Small quantity generators (SQGs) in Arkansas are not exempt from manifest requirements when recycling hazardous waste, as they are under the federal rules. Arkansas's conditionally exempt small quantity generators (CESQGs) are subject to additional requirements in connection with on-site storage and shipping hazardous waste off-site. The state also requires payment of annual hazardous waste generator fees.
