Comparison: State vs. Federal
• Rules. Tennessee has adopted the U.S. Environmental Protection Agency's (EPA) Hazardous Waste Generator Improvements Rule, effective in Tennessee as of May 13, 2021, which includes standards for generators accumulating hazardous waste on-site in tanks. The state follows the federal requirements for tanks that store or treat hazardous waste. In addition, Tennessee requires owners and operators of hazardous waste treatment, storage, and disposal facilities (TSDFs) using tanks to pay various permit fees as well as an annual facility maintenance fee. • Administration and enforcement. The state’s hazardous waste tank requirements are administered and enforced by TDEC’s Division of Solid Waste Management.
