Comparison: State vs. Federal
• Rules. Mississippi adopts by reference the federal hazardous waste treatment rules for hazardous waste treatment facilities. Treatment facilities in Mississippi must also comply with additional state permit requirements and pay certain treatment and pollution prevention fees. Note: The state has adopted the federal regulations applicable to this topic amended through December 31, 2008.
As under the federal rules, Mississippi allows hazardous waste generators to treat hazardous waste on-site without a permit, provided the generator treats hazardous waste in accumulation units such as tanks or containers that are in full compliance with the accumulation requirements set forth at 40 CFR 262.34 and the unit-specific requirements set forth at 40 CFR 265.
