• Rules. Arizona incorporates by reference the federal rules for land disposal restrictions (LDRs), including the Phase IV federal LDRs and best demonstrated available technology (BDAT) that were in effect as of July 14, 2006. Arizona has not adopted the federal provision at 40 CFR 268.14, which is an exemption from the prohibition of placing otherwise prohibited waste in a surface impoundment for storage or treatment if the waste has been newly identified as a characteristic or listed waste. In addition, the state does not administer the following federal LDRs because U.S. Environmental Protection Agency (EPA) has not delegated authority to states to implement these rules:
—Case-by-case extensions (40 CFR 268.5)
—No-migration variances (40 CFR 268.6)
—Equivalent method variances (40 CFR 268.42(b))
—Variances from treatment standards (40 CFR 268.44)
