Comparison: State vs. Federal
• Rules. Connecticut has incorporated the federal land disposal restrictions (LDRs) by reference through the July 1, 2000, edition of the Federal Register, with several exceptions. The state has adopted most of the federal Phase IV LDRs. including those issued since July 1, 2000. Any regulation that was issued under the Hazardous and Solid Waste Amendments (HSWA) to the Resource Conservation and Recovery Act (RCRA) are automatically in effect. Restrictions that were not issued pursuant to HSWA or that are less stringent than existing state regulations will not be effective until adopted by the state. Connecticut has incorporated by reference the federal LDRs with the exception of several provisions, including those federal rules not delegated by the U.S. Environmental Protection Agency (EPA) to the states.
