• Rules. Florida incorporates by reference the federal rules for land disposal restrictions (LDRs), including the Phase IV federal LDRs and best demonstrated available technology (BDAT). Florida has not adopted the following federal LDRs because U.S. Environmental Protection Agency (EPA) has not delegated authority to states to implement these rules (FAC 62-730.183(1)):
—Case-by-case extensions (40 CFR 268.5)
—No-migration variances (40 CFR 268.6)
—Equivalent method variances (40 CFR 268.42(b))
—Exemption from a treatment standard (40 CFR 268.44)
In addition, Florida excludes labpacks containing D009 wastes from the provision for generators regarding the need not to determine underlying hazardous constituents.
