Rules. Illinois incorporates by reference the federal rules for land disposal restrictions (LDRs). Although Illinois has adopted the following federal LDRs, the state is not authorized to implement them because the U.S. Environmental Protection Agency (EPA) has not delegated authority to states to implement these rules:

—Case-by-case extensions (40 CFR 268.5)

—No-migration variances (40 CFR 268.6)

—Equivalent method variances (40 CFR 268.42(b))

—Variances from treatment standards (40 CFR 268.44)

Although Illinois formerly allowed petitions for "an adjusted" LDR treatment standard, the state has revised its "Adjustment of a Treatment Standard" regulation at 35 IAC 728.144 not only to rename the regulation as "US EPA Variance From a Treatment Standard" but also to emphasize that "a variance from a treatment standard is available only from US EPA." The standards of the regulation that must be met for the EPA to consider granting a variance from a treatment standard parallel those in the federal rule 40 CFR 268.44.
