Comparison: State vs. Federal
• Rules. Indiana has incorporated by reference the federal land disposal restrictions (LDRs) with the exception of several provisions, including those federal rules not delegated by the U.S. Environmental Protection Agency (EPA) to the states.
• Administration and enforcement. Indiana's hazardous waste management program is authorized by EPA and administered by IDEM. However, when new regulations are issued under the Hazardous and Solid Waste Amendments (HSWA) to RCRA, EPA will administer these new regulations until the time that an equivalent or more stringent rule is adopted.
