Comparison: State vs. Federal
• Rules. Minnesota incorporates by reference most of the federal rules for land disposal restrictions (LDRs) and best demonstrated available technology (BDAT). The state does not incorporate these federal provisions:
—40 CFR 268.1(c)(3) regarding disposal into injection wells
—Most of the definitions in 40 CFR 268.2
—40 CFR 268.7(a)(9)(iii) regarding the exemption from determining the underlying hazardous constituents of D009 in lab packs
—40 CFR 268.4(a)(3)(ii) to (iii) regarding a waiver or modification of surface impoundment design requirements in connection with the LDR surface impoundment treatment exemption.
• Administration and enforcement. Minnesota's LDRs are administered and enforced by DNR's Hazardous Waste Management Branch. The EPA-administered provisions that Minnesota does not incorporate by reference are implemented by EPA's Region 5 office.
