Comparison: State vs. Federal
• Rules. New Jersey has adopted by reference the vast majority of the federal rules for land disposal restrictions (LDRs) and best demonstrated available technology. These rules are reviewed in the national section LAND DISPOSAL RESTRICTIONS/LAND BAN. The federal rules that New Jersey have not adopted are those that EPA has not delegated authority to New Jersey to administer and enforce.
• Administration and enforcement. DEP's Solid and Hazardous Waste Management Program is responsible for the administration and enforcement of the state's LDRs. When new, more-stringent regulations are issued under the Hazardous and Solid Waste Amendments (HSWA) to the Resource Conservation and Recovery Act (RCRA), EPA will administer these new regulations until the time that equivalent or more-stringent rules are adopted in New Jersey.
