Comparison: State vs. Federal

Rules. The federal rules are in effect in Rhode Island as there are no state land disposal restriction regulations (LDRs) (RI Rule 12.030.003-2.2B). See the national section LAND DISPOSAL RESTRICTIONS/LAND BAN to review these federal rules. Consequently, all federal LDR provisions, such as the one-time notification rule for generators, are in effect in the state.

Administration and enforcement. Rhode Island's hazardous waste management program is authorized by EPA and administered by DEM's Bureau of Environmental Protection. However, all administration and enforcement of the LDRs are conducted by the EPA Region 1 office, which will administer these regulations until equivalent or more stringent rules are adopted by the state.
