Rules. West Virginia has incorporated by reference the federal rules for land treatment. West Virginia requires owners and operators of land treatment facilities in West Virginia to comply with the federal land treatment facility rules. In addition, owners and operators of hazardous waste treatment, storage, and disposal facilities (TSDFs) that engage in land treatment activities must comply with additional permit application requirements and pay several state permit and facility fees.

Administration and enforcement. DEP's Division of Water and Waste Management administers and enforces the land treatment rules in West Virginia.

Hazardous waste facility owners and operators in West Virginia are subject to several additional state permit conditions not included in the federal rules. The state has additional permit application requirements for TSDFs, including those regarding siting standards.
