Comparison: State vs. Federal

• Rules. At present, Tennessee has no commercial landfills that accept hazardous waste. However, the state's hazardous waste management program retains hazardous waste landfill regulations that follow the federal rules. In addition, any owner or operator of a hazardous waste landfill is required to comply with the state's hazardous waste permit and fee requirements, including a disposal facility maintenance fee. Note: Many states do accept lab packs for disposal. Always check another state's lab pack rules before sending the lab pack out of state for disposal.

Tennessee has its own rules for solid (nonhazardous) waste landfills. In addition, the federal solid waste landfill requirements apply in Tennessee. See the state section SOLID WASTE for more information.

• Administration and enforcement. The Tennessee Department of Environment and Conservation's Division of Solid and Hazardous Waste Management administers and enforces both the hazardous and solid (nonhazardous) waste landfill requirements in Tennessee.
