Rules. West Virginia has adopted by reference the federal surface impoundment rules. In addition, West Virginia has its own more stringent permit requirements for hazardous waste treatment, storage, and disposal facilities (TSDFs) using surface impoundments, including the requirement to pay a permit application fee. Administration and enforcement. DEP's Environmental Enforcement Branch administers and enforces the surface impoundment rules in West Virginia.
