Comparison: State vs. Federal
• Rules. West Virginia has adopted by reference the federal regulations for the management of universal wastes, including those for mercury-containing equipment. In addition, West Virginia has its own state requirements for petitions and exports.
• Administration and enforcement. DEP's Hazardous Waste Unit administers and enforces the universal waste rules in West Virginia.
Exports of universal waste from the state to a foreign destination must be done in accordance with the federal rules. In addition, exporters must provide DEP with copies of all documentation, manifests, exception reports, annual reports, or records that they submit to EPA as part of the federal exporting requirements.
