Comparison: State vs. Federal

Rules. Utah has been granted authority by EPA to administer the National Pollutant Discharge Elimination System (NPDES) permit program in the state, including pretreatment standards. The Utah Pollutant Discharge Elimination System (UPDES) program is the state's equivalent to the federal NPDES permit program.

The state has adopted the federal pretreatment regulations for industrial users who discharge their waste into publicly owned treatment works (POTW) (R317-8-1). See the national section PRETREATMENT STANDARDS for details. Utah has also promulgated its own pretreatment substantive and procedural requirements for pretreatment programs.

Utah has also developed requirements for the construction of on-site wastewater treatment systems (R317-4-1 to R317-4-13).

Administration and enforcement. The Utah Water Quality Board is responsible for the administration and enforcement of the UPDES program, including for pretreatment.
