Comparison: State vs. Federal

Rules. Colorado is authorized by the U.S. Environmental Protection Agency (EPA) to administer the federal National Pollutant Discharge Elimination System (NPDES) program, including stormwater discharge permits. The state's permit program is known as the Colorado Discharge Permit System (CDPS) and is the state equivalent of the NPDES permit program. The state generally follows the federal rules for stormwater permitting but uses state application forms and requires permit fees. See the national section STORMWATER—GENERAL for more information regarding the federal permitting program. Additionally, some CDPS permits extend to certain groundwater discharges. For instance, the CDPS General Permit for Stormwater Discharges Associated with Construction Activities applies to both surface water and groundwater discharges, such as those from cement washout. Permittees should examine their permits to determine whether or not their groundwater discharges are authorized.

Administration and enforcement. The CDPHE's WQCD is responsible for the administration and enforcement of the stormwater discharge permit regulations in Colorado.
