Rules. West Virginia is authorized by the U.S. Environmental Protection Agency (EPA) to issue wastewater permits under the National Pollutant Discharge Elimination System (NPDES) program, including for stormwater discharges. The state NPDES program generally follows the federal requirements. See the national section STORMWATER—GENERAL for more information.

The West Virginia Department of Environmental Protection (DEP) issues three NPDES general stormwater permits. The construction general permit covers all earth-disturbing construction activities that affect more than 1 acre. The multisector general permit covers stormwater discharges related to industrial activities, and the municipal separate storm sewer system (MS4) permit covers discharges from certain municipalities and other public entities. The DEP also issues individual permits for stormwater discharges.
