Comparison: State vs. Federal
· Rules. Wyoming is authorized to administer the federal National Pollutant Discharge Elimination System (NPDES) program for stormwater discharges. The state issues individual permits and general permits for discharges associated with industrial facilities, construction activities, mineral mining, and municipal separate storm sewer systems (MS4s). The NPDES program is known as the Wyoming Pollution Discharge Elimination System (WYPDES) in the state.
Wyoming rules are more stringent because some types of general permits are not available where stormwater has a potential to discharge to Class 1 waters. In these areas the facility may apply for an individual stormwater permit. Wyoming also charges stormwater permit fees.
