Comparison: State vs. Federal
• Rules. California is authorized by the U.S. Environmental Protection Agency (EPA) to administer stormwater permits under the National Pollutant Discharge Elimination System (NPDES) permit program, including permits that cover discharges associated with municipal separate storm sewer systems (MS4s). The state generally follows the federal permitting regulations and has given authority to regional water boards to administer stormwater permits. California issues a statewide permit that regulates all discharges from California Department of Transportation (Caltrans) MS4s, maintenance facilities, and construction activities.
• Administration and enforcement. SWRCB's Division of Water Quality is responsible for the administration and enforcement of the stormwater discharge permit regulations in California. Stormwater discharge general permits are implemented and enforced by the nine RWQCBs.
