Comparison: State vs. Federal

Rules. Pennsylvania is fully authorized to administer the National Pollutant Discharge Elimination System (NPDES) permit program, including for municipal point source discharges related to stormwater. Pennsylvania generally follows the federal permitting regulations for stormwater discharges under 40 CFR 122.26. Pennsylvania has developed its own general permits covering municipal separate storm sewer systems (MS4s). For additional guidance, see the national section STORMWATER—MUNICIPALITIES.

Administration and enforcement. DEP's Bureau of Point and Nonpoint Source Management administers and enforces the stormwater discharge permit rules in Pennsylvania.
