Wyoming COBRA (Health Insurance Continuation): What you need to know

Both Wyoming law and the federal Consolidated Omnibus Budget Reconciliation Act (COBRA) permit employees to continue their group health coverage if they leave the group for certain specified reasons. Wyoming's law covers insured group hospital, surgical, and major medical plans sponsored by all employers not covered by federal COBRA, regardless of size, except those that are self-insured (WY Stat. Sec. 26-19-113).

Employees and their covered dependents who lose coverage because of a termination of employment or eligibility for coverage are entitled to 12 months of continuation coverage if they were covered for the previous three months.
Continuation is not available for any person who is covered by Medicare or covered by any other insured or uninsured arrangement that provides group hospital, surgical, or medical coverage. Continuation does not have to include dental or vision care benefits or any other benefits provided under the group policy other than hospital, surgical, or major medical benefits unless the insurer previously included such benefits and the insured requests those benefits.
Notice, election, and premium payment requirements. Notice of continuation rights must be included in the certificates of coverage. Elections of continuation coverage must be made within 31 days following the termination of coverage. Premiums must be paid to the insurer, a third-party administrator, or the employer, as designated by the employer, on a monthly basis in advance and may not exceed 102 percent of the group rate for the insurance being continued under the group policy as of the due date of each payment.
