Louisiana Deductions from Pay: What you need to know

Employers must make deductions from employees’ pay for federal, state, and local withholding taxes. In general, before making any other deductions from an employee’s pay, the employer must first obtain the employee’s written authorization. Employers may fine employees for willfully or negligently damaging or breaking the employer's property (LA Rev. Stat. Sec. 23:635). Failing to return employer property when requested could be considered willful damage to that property. The fine may not exceed the value of actual damage done.
An assignment of earnings is an agreement between an employee and one of his or her creditors, under which the employee voluntarily gives the creditor the right to collect a portion of the employee's wages for repayment of a debt. An assignment of earnings should not be confused with an income assignment. An income assignment is Louisiana's term for a support garnishment. Employers may deduct from employee wages for assignments of earnings. An employer is not obligated to honor an assignment of earnings unless it has consented to the assignment in writing. Employers may not discharge or refuse to hire anyone because he or she has assigned his or her earnings voluntarily (LA Rev. Stat. Sec. 23:731).
