Alaska Exempt Personnel: What you need to know

Alaska law requires employers to pay employees overtime (11/2 times their regular rate of pay) if they work over 40 hours in a week or 8 hours in a day.
Individuals employed in a bona fide administrative, executive, and professional capacity who pass the duties tests are exempt from the overtime provisions of the law (AK Stat. Sec. 23.10.055).

In Alaska, working in a bona fide executive, administrative, professional, or outside sales capacity has the same meaning as under the federal Fair Labor Standards Act (FLSA).
Note: The federal Department of Labor’s (DOL) final overtime regulations, effective December 1, 2016, have increased the salary level for exemption, will automatically update the salary threshold every 3 years going forward, and have allowed for the inclusion of nondiscretionary bonuses, incentive payments, and commissions toward as much as 10 percent of the salary threshold.
