Indiana Hours of Work: What you need to know

Indiana law requires private employers to pay overtime after 40 hours per week (IN Code Sec. 22-2-2-4). Unless otherwise provided, the normal workweek for employees working for the state is 371/2hours (IN Admin. Code Tit. 31 Sec. 1-9-1). State employees receive overtime after working 371/2hours in a week (IN Admin. Code Tit. 31 Sec. 1-9-2).

Indiana law sets strict limits on the hours that may be worked by children under the age of 18, especially children of compulsory school age.
Railroad transportation. Railroad workers engaged in the movement of trains must be allowed 10 hours of rest after 12 consecutive hours of work and 8 hours of rest within any 24-hour period in which the employee has worked 12 hours in the aggregate (IN Code Sec. 22-2-2-4).
Hospitals. Hospitals and residential care facilities may enter into an agreement with employees for a work period of 14 consecutive days instead of 7 consecutive days. However, the employee must be paid no less than 1.5 times the regular rate for employment in excess of 8 hours in a workday or 80 hours in that 14-day period (IN Code Sec. 22-2-2-4).
Retail and service industries. Employers do not violate the law if the employee's regular rate of pay is in excess of 1.5 times the minimum wage, and more than half of the employee's compensation is in commissions (IN Code Sec. 22-2-2-4).
