South Carolina Hours of Work: What you need to know

Minimum wage and overtime. South Carolina has not enacted any minimum wage and overtime laws. Consequently, such issues are governed by the Fair Labor Standards Act, a federal law.

Sunday labor. South Carolina prohibits conducting certain business activities on Sundays. To determine whether particular businesses may operate on Sundays, employers should refer to the “blue laws” (SC Code Sec. 53-1-5et seq.) or contact the South Carolina Department of Labor. Any employer that dismisses or demotes an employee because he or she is a conscientious objector to Sunday work may be subject to triple damages plus court costs and attorneys' fees. The court may also order the employer to rehire or reinstate the employee in the same position he or she was in before the dismissal or demotion.
Restricted hours for minors. South Carolina law limits the number of hours that minors may work. South Carolina's child labor laws are quite detailed. Anyone planning to employ minors during unusual hours or for lengthy workdays should consult the South Carolina Department of Labor, Licensing and Regulation for specific information.
