Excluded from coverage by the state minimum wage are (IN Stat. Sec. 22-2-2-4):
• Employers with fewer than two employees
• Agricultural workers
• Children under the age of 16
• Workers performing services outside the ordinary course of the employer's business
• Insurance agents and outside salespersons who are paid by commission
• Employees of a parent, spouse, or child
• Members and volunteers of religious orders and charitable organizations
• Student nurses
• Student funeral directors and embalmers
• Hospital interns and residents
• Students working for their schools
• Individuals with disabilities working for nonprofit organizations
• Employees of nonprofit summer camps and other camping, recreational, or guidance facilities
• Motor transport employees covered by the federal Motor Carrier Act
• Employees of agencies that provide companionship services to the aged and infirm
• Individuals who are employed for not more than 4 weeks in any 4 consecutive calendar quarters (but there are penalties for consistently replacing workers at the end of 4 weeks without sound business reasons)
In addition, the state provides exemptions for certain white-collar employees that are substantially identical to the corresponding federal exemptions. Further information about these occupations.
Employees under the age of 20 may be paid the youth minimum wage allowed under the Fair Labor Standards Act (FLSA) during the first 90 calendar days of employment(IN Stat. Sec. 22-2-2-4(j)).
