Several occupations and industries are exempt from Maine's minimum wage provisions, including (ME Rev. Stat. Tit. 26 Sec. 664 et seq.):
• Most agricultural workers
• Domestic workers in private homes who are employed directly by the resident, owner, or family of the resident or homeowner
• Outside salespeople paid by commission
• Employees of public-supported and educational nonprofit organizations, except political bodies
• Counselors, junior counselors, or counselors-in-training at licensed summer camps
• Employees under the age of 18 working at seasonal recreation programs operated by nonprofit organizations (exemption formerly applied only to students under the age of 19)
• Fishermen and first processors of seafood
• Switchboard operators in certain small public telephone exchanges
• Unsupervised homeworkers
• Members of the employer's immediate family who are the employer's dependents
• Taxi drivers
• Employees who devote most of their work time to executive, administrative, or professional duties and meet salary threshold. State salary threshold, when weekly salary is converted to an annual rate, must exceed 3,000 times Maine’s minimum hourly wage.
The state director of Labor and Industry may issue special certificates allowing employment at wages below the minimum for learners, apprentices, and handicapped workers.
