South Dakota Minimum Wage: What you need to know

The following workers are exempt from South Dakota's minimum wage provisions (SD Cod. Laws Sec. 60-11-3):
• Babysitters
• Outside salespersons
• Employees working for less than minimum wage under special permit
The state Department of Labor may issue special certificates allowing employment at wages below minimum for:
• Apprentices
• Learners
• Individuals with disabilities
Every employer with at least one employee who is covered by the federal Fair Labor Standards Act (FLSA) must post a notice outlining the federal minimum wage requirements. This notice is available on the U.S. Department of Labor's website at http://www.dol.gov/whdor by contacting:
