Wyoming Affirmative Action: What you need to know

The Wyoming Fair Employment Practices Act prohibits discrimination in employment on the basis of age, sex, race, creed, color, national origin, ancestry, disability or pregnancy (WY Stat. Sec. 27-9-105et seq.). The law applies to all public employers and private employers with two or more employees within the state; but it does not apply to religious organizations or associations (WY Stat. Sec. 27-9-102). There are no specific affirmative action provisions covering private employers.

The Department of Employment has labor market statistics and can be reached at doe.state.wy.us/lmi. The state Economic Analysis Division (EAD) also receives Census Bureau data for the state and makes that information available to the public. The EAD offers special services not offered by the U.S. Census Bureau, such as marketing research, online data, guides to local data sources, maps displaying data, state profiles using census data, and reference libraries. The Wyoming Department of Workforce Services enforces the state Fair Employment Practices Act. The Department is authorized to initiate, receive, and investigate discrimination complaints, issue subpoenas, hold hearings, issue administrative decisions and orders, and enforce its decision in state court. In certain instances, a person alleging discrimination may also file a private lawsuit in state court. Remedies can include cease-and-desist orders, hiring, reinstatement or promotion, or back pay.
