Mississippi Death of Employee: What you need to know

If the estate of a deceased employee is not being administered by the chancery court, an employer may pay wages, salary, or other compensation due a deceased employee to the decedent's family members (in order of priority):
• Surviving spouse
• Adult children
• Mother
• Father
• Adult brothers and sisters
If none of these relatives survive the employee, or if the surviving children or siblings are minors, the employer may make payment to the chancery court clerk of the county where the employee resided or where he or she died (MS Code Sec. 91-7-323, Sec. 91-7-329).
