New Jersey First Aid: What you need to know

New Jersey does not require employers to provide first aid in the workplace, nor does the state have its own occupational safety and health plan for private employers. Therefore, in the private sector, the federal Occupational Safety and Health Act (OSH Act) governs workplace health and safety. Public sector workplaces (state and local governments and schools) are governed by state safety and health laws, which adopt the federal standards for first aid by reference.

Anyone (including any healthcare provider, volunteer emergency medical technician, or voluntary ambulance or rescue squad association member) who provides first aid in good faith at the scene of an emergency or accident is immune from civil liability for acts he or she may or may not have performed in providing such emergency care; there is an exception if these acts or omissions amount to willful or wanton misconduct. This immunity from liability does not extend to employees trained in health care that render emergency care as part of their regular duties for pay or with the expectation of being paid (NJ Rev. Stat. Sec. 2A:62A-1et seq.).
