New York does not have its own occupational safety and health regulatory program for private sector employers. Therefore, in the private sector, the federal Occupational Safety and Health Act (OSH Act) governs workplace health and safety. Public sector (state and local government offices and operations) workplaces are governed by state occupational safety and health rules administered by the New York Department of Labor/Division of Safety and Health.
