Kentucky OSHA: What you need to know

The federal Occupational Safety and Health Act (OSH Act) is “preemptive”; that is, it overrides state laws and regulations in the areas it covers. Since it covers virtually all areas of workplace health and safety in the private sector, it supplants most state work safety requirements. Under the OSH Act, individual states may devise and administer their own standards, but only with federal approval and only if the applicable state requirements are as stringent as the corresponding federal standards. The U.S. Department of Labor/Occupational Safety and Health Administration (OSHA) administers the federal law.

Kentucky is a “state plan” state, which means it has received federal approval for its state regulatory program, the Occupational Safety and Health Act (Kentucky OSH Act), that governs both private and public workplaces (KY Rev. Stat. Sec. 338.011et seq.; KY Admin. Code Tit. 803 Sec. 2:010 et seq.).
Kentucky has adopted the federal standards by reference and adopted additional requirements that are stricter than federal standards for first aid, lockout procedures for hazardous energy (lockout/tagout), and noise (hearing) protection. The Kentucky Labor Cabinet/Office of Occupational Safety and Health/Division of Compliance enforces the state standards. OSHA administers the federal law for federal agencies and facilities located in the state.
