Idaho Smoking: What you need to know

Idaho's Clean Indoor Air Act prohibits smoking at public meetings and in public places (ID Code Sec. 39-5501et seq.). “Public place” is defined as any enclosed indoor place of business, commerce, or other service-related activity, publicly or privately owned, to which the public has general access. Restrooms, waiting rooms, and public transportation vehicles are also included in the prohibition.

Smoking is prohibited in restaurants (including bars in restaurants), cafeterias, schools and grounds, hospitals and grounds, bowling alleys, and common rooms in nursing homes. Smoking is prohibited within 20 feet of entrances and exits to schools and healthcare facilities.
Exemptions. Smoking is permitted in businesses that are located in the owner's home and certain areas of employer-operated businesses (see Private Employers section below), ; stand-alone bars as defined in the Act; buildings owned or operated by social, religious, or fraternal organizations or rented by members for events not open to the public; state veterans' homes; designated rooms in hotels and motels; and tobacco retail stores.
Posting. In facilities where smoking is allowed under the Act, all entrances must be clearly posted with signs warning that the facility permits smoking.
Violations. Any employer or person in charge of a public place who knowingly violates these provisions is subject to a fine of $100.
An employer is permitted to ask an employee or person smoking in violation of this law to extinguish the lighted tobacco product and/or leave. Any person who refuses to leave is in violation of the law and may be fined up to $50. Violations may be reported to local law enforcement agencies.
