Minnesota Smoking: What you need to know

The Freedom to Breathe (FTB) provisions of the Minnesota Clean Indoor Air Act (MCIAA) prohibit smoking in enclosed workplaces with two or more individuals and in virtually all indoor areas used by the public (MN Stat. Sec. 144.411et seq).

Under the FTB provisions, smoking is also prohibited in public and private educational facilities, healthcare facilities; home offices with one or more on-site employees; bars, restaurants, and private clubs; common rooms in lodging facilities; and commercial vehicles with more than one person, public vehicles and facilities, and for-hire vehicles such as limousines and taxis.
The FTB provisions of the MCIAA permit smoking in these locations:
• Private homes and vehicles when not used for business purposes open to the public, such as child care or day care
• Workplaces on family farms with two or fewer nonfamily employees
• Designated rooms in adult residential-care facilities
• Designated sleeping rooms in hotels and motels
• Cabs of heavy commercial vehicles (over 26,000 pounds) registered with the Minnesota Department of Transportation
• Truck-loading docks, garages, and terminals
• Farm and construction vehicles
• Tobacco shops
• Traditional ceremonies of Native Americans
Prohibitions. The MCIAA prohibits the use of e-cigarettes in:
• Buildings owned or operated by the state of Minnesota, including facilities of the Minnesota Department of Human Services, Minnesota state colleges and universities, and the University of Minnesota
• Buildings owned and operated by local governments
• Licensed daycare facilities
• Healthcare facilities, including clinics, licensed by the Commissioner of Health
