Arizona Advertising: What you need to know

The Arizona Civil Rights Act prohibits employers, employment agencies, and labor organizations from printing or publishing (or causing to be printed or published) any application, statement, advertisement, or publication for employment, apprenticeship, or other training program that inquires about or expresses a preference, specification, limitation, or discrimination based on race, color, religion, sex, age, or national origin unless that characteristic is a bona fide occupational qualification for employment (AZ Rev. Stat. Sec. 41-1464).

The Act applies to employers with 15 or more employees.
Phoenix. The city of Phoenix prohibits private employers from discrimination on the basis of race, color, religion, sex, national origin, age (40 years or older) disability, genetic information, sexual orientation, gender identity or expression, or marital status (Phoenix City Code Ch. 18, Art. I, Sec. 18-4).
Tucson. The city of Tucson prohibits employers from discrimination based on race, color, religion, ancestry, sex, age, disability, national origin, sexual orientation, gender identity, familial status, and marital status (Tucson Adm. Code, Art. III, Sec. 17-11 et seq.).
The Navajo Preference in Employment Act (NPEA) requires employers that plan on doing business within the Navaho Nation to include a Navajo employment preference policy statement in all job announcements and advertisements and use Navajo Nation employment sources and job recruitment services. An employer must advertise with at least one Navajo Nation newspaper and radio station and post a Navajo preference policy prepared by the Office of Navajo Labor Relations on the jobsite.
