Hawaii Advertising: What you need to know

Hawaii law prohibits an employer of any size or an employment agency from printing or circulating (or causing to be printed or circulated) any statement, advertisement, or publication that expresses, directly or indirectly, any limitation, specification, or discrimination based on race, sex, sexual orientation, age, color, religion, ancestry, marital status, disability, National Guard obligations, or arrest and court record (HI Rev. Stat. Sec. 76-1andHI Rev. Stat. Sec. 378-1).

This prohibition does not apply to any of these characteristics that are a bona fide occupational qualification for employment or to religious organizations or institutions controlled by a religious organization, which may indicate a preference for employees of the same religion if the job entails promoting the principles of that religion (HI Rev. Stat. Sec. 378-3).
