Kentucky Hiring: What you need to know

The Kentucky Civil Rights Act prohibits hiring practices that discriminate against job applicants on the basis of race, color, religion, national origin, sex, age, disability, or because the applicant is a smoker or nonsmoker as long as the individual complies with workplace policies on smoking (KY Rev. Stat. Sec. 344.010 et seq.). The Act applies to employers with eight or more employees. The provision on disability discrimination applies to employers with 15 or more employees.
Kentucky also has an Equal Opportunities Act that prohibits hiring discrimination on the basis of disability (KY Rev. Stat. Sec. 207.130 et seq.). The Equal Opportunities Act applies to employers with eight or more employees.

Kentucky's new hire reporting law requires all employers to report the name, address, Social Security number, and date of hire of each new employee to the state within 20 days of the date of hire (KY Rev. Stat. Sec. 405.435). Employers must also report the rehire of any employee who was previously laid off, furloughed, terminated, or placed on leave without pay. Failure to report as required can result in the assessment of fines against the employer.
