Delaware is not a “state plan” state; that is, it does not have a federally approved occupational safety and health (OSH) program. Consequently, the federal OSH Act governs workplace safety and health requirements in the private sector. There are no enforceable state safety and health rules for public sector (state and local government operations) workplaces.
