West Virginia is not a “state plan” state; that is, it does not have a federally approved occupational safety and health program. Therefore, the federal Occupational Safety and Health Act (OSH Act) governs workplace safety and health in the private sector (private businesses, commercial establishments, and nonprofit organizations).
The state has adopted the federal fall protection requirements for state government workplaces.The Occupational Safety and Health Administration (OSHA) administers and enforces occupational safety and health in the private sector workplace. The West Virginia Division of Labor inspects state government workplaces in response to fatalities and employee complaints.
