The state has a federally approved occupational safety and health regulatory program for public sector (state and local government) workplaces. It has adopted by reference the federal emergency action plan rules for public sector workplaces in general industry (12 NYCRR 800.3).

The federal Occupational Safety and Health Administration (OSHA) administers and enforces occupational safety and health requirements in private sector workplaces. The New York Department of Labor/Employee Safety and Health (PESH) Bureau administers and enforces occupational safety and health requirements in public sector workplaces.
