New Mexico has adopted the federal OSHA regulations on emergency action and fire prevention plans in the New Mexico Occupational Safety and Health Act, NMSA 50-9-13 and 11 NMAC 5.2.9.

Employers are also required to comply with the life safety requirements contained in the National Fire Protection Association (NFPA) Code 1 Fire Prevention and NFPA Code 101 Life Safety, which have been adopted by the New Mexico State Fire Marshal.

New Mexico Occupational Health and Safety Bureau (OHSB) administers and enforces workplace safety and health rules in the state.
