The level of first-aid services maintained will depend on the hazards normally present at the worksite. Both the law and good common sense require at least a basic level of readiness. South Dakota does not have its own occupational safety and health plan for private sector (private businesses and nonprofit organizations) employers. Therefore, in the private sector, the federal Occupational Safety and Health Act (OSH Act) governs workplace health and safety. A detailed discussion of workplace first-aid requirements is available. A person (including a peace officer or a member of the fire or police department) who provides emergency care in good faith at the scene of an emergency or accident is immune from civil liability for acts that he or she may have performed in providing such care. Immunity does not apply if the acts or omissions amount to willful, wanton, or reckless acts. This immunity from liability does not extend to employees trained in health care who render emergency care for pay or with the expectation of being paid (SD Cod. Laws Sec. 20-9-4.1et seq.).
