Private Employers

Private employers may adopt policies prohibiting employees and visitors from possessing weapons on employer property (Hansen v. America Online, Inc., 96 P.3d 950 (Utah 2004)).

Local authorities and state entities may not prohibit individuals from possessing firearms at their place of business or in their vehicles. Thus, state and local governmental employers may not prohibit employees from possessing firearms at work. However, certain secure facilities, such as correctional and mental health facilities and courthouses, may prohibit the possession of weapons on their premises (UT Code Secs. 53-5a-102, 76-8-311.1, 76-8-311.3, and 78A-2-203).
