Virginia has adopted by reference the federal rules for process safety management (PSM) of highly hazardous chemicals in general industry (16 VAC 25-90-1910). Virginia employers are subject to state requirements that are identical to the federal rules.
The federal rule for PSM of highly hazardous chemicals is intended to prevent or minimize the consequences of a catastrophic release of toxic, reactive, flammable, or explosive chemicals from a process (29 CFR 1910.119). A process is any activity or combination of activities including any use, storage, manufacturing, handling, or on-site movement of highly hazardous chemicals. The rule applies to a process that contains a threshold quantity or greater amount of a toxic or reactive chemical.
The Virginia Department of Labor and Industry (DOLI) administers the state plan program.
